Terms of Use

These terms are the agreement between you and Emerge Labs, LLC for the use of Our Plan (the “app”). By creating an account or using the app, you agree to them. If you do not agree, please don’t use the app.

What Our Plan is

Our Plan is a household coordination service. It helps a household organize its preparedness information — meeting places, contacts, and plans — in one shared place, and surfaces public safety information from authoritative federal sources so the household has shared awareness when conditions change. It is a coordination and information tool, not an emergency service.

Not a substitute for emergency services

In a life-threatening emergency, always contact your local emergency number (such as 911) first. Our Plan does not contact emergency responders on your behalf, and it is not a real-time safety system. Check-ins and messages are delivered over text, email, and the internet, which can be delayed or fail for reasons outside our control — no network, a carrier outage, a wrong number, or a lost signal. We can’t guarantee that any message is sent, delivered, or read, and hazard and weather information (sourced from agencies such as NWS, USGS, AirNow, NIFC, and NOAA) may be incomplete or out of date. The timing of those publications is set by those agencies, not by us.

Information, not advice

Preparedness information in the app — checklists, prompts, look-ahead suggestions, and any general guidance we summarize — is general information, not professional, emergency, medical, legal, or financial advice. Where it summarizes published guidance, we name the source so you can read the original. It is not tailored to your household, your building, or your situation, and it is not reviewed against your circumstances.

Our Plan does not tell you what to do. Decisions about whether to stay, leave, shelter, or seek help are yours, and where officials have issued instructions, theirs. Local emergency management, the National Weather Service, and other authorities are the authority on those decisions — always follow what they publish over anything you read in the app. Hazard and weather information is passed through from those agencies and may be incomplete, delayed, or out of date.

Membership, billing, and renewal

Our Plan is free for one person, pets included. A paid subscription (the “Membership”) adds the rest of your household — more people on the plan, invites, and sending check-ins. One Membership covers your whole household, with no second subscription. It is offered as a monthly or yearly plan.

  • Payment is charged to your Apple ID at confirmation of purchase.
  • The Membership renews automatically at the then-current price unless auto-renew is turned off at least 24 hours before the end of the current period.
  • Your account is charged for renewal within 24 hours before the period ends.
  • You can manage or cancel your Membership, and turn off auto-renew, in your Apple ID account settings after purchase.
  • Prices are shown in the app before you buy and may vary by region. We may change prices for future periods; a change never applies to a period you’ve already paid for.

Purchases are handled by Apple and are subject to Apple’s terms. Refunds are handled by Apple, not by us — request them through Apple.

If your Membership ends

If your Membership lapses, your household goes back to the free plan: just the plan’s owner, plus any pets. Everyone else on the plan is paused — hidden from the plan, and anyone who joined from their own phone can’t open it — and check-ins stop. Nothing is deleted: when the Membership is renewed, everyone comes back as they were.

Using the app responsibly

You agree to:

  • Add contacts and phone numbers only when you have permission to reach those people.
  • Use check-ins and messages for their purpose — not for spam, harassment, or false alarms.
  • Keep your account credentials to yourself, and be at least the age of majority where you live (or have a parent or guardian’s consent).
  • Not misuse, disrupt, reverse-engineer, or attempt to break the app or its servers.

We may suspend or end access that abuses the service or these terms.

Your content

Your plan, contacts, places, and messages are yours. You give us permission to store and process them only to run the service for you — for example, to deliver a check-in to the contacts you chose. See the Privacy Policy for how we handle your information.

Disclaimers and limits

The app is provided “as is,” without warranties of any kind, to the fullest extent the law allows. To the fullest extent permitted by law, Emerge Labs, LLC is not liable for indirect, incidental, or consequential damages, or for any harm arising from a delayed, failed, or undelivered message, check-in, or hazard notice. Some places don’t allow certain limits, so parts of this may not apply to you.

Apple

The app is licensed to you, not sold. This license follows the Apple Licensed Application End User License Agreement. Apple is not responsible for the app or its content, and is not a party to these terms — though Apple may enforce them as a third-party beneficiary.

Changes

We may update these terms. If we make a material change, we’ll update the date above and, where appropriate, let you know in the app. Continuing to use the app after a change means you accept the updated terms.
